If you received a Class Action Notice, you have been identified as a class member in this Settlement. A New Mexico state court authorized the notice. It is not an advertisement from a lawyer. The notice is to tell you about proposed settlement of a class action lawsuit that was filed in the Third Judicial District in Dona Ana County. The lawsuit is called, Las Cruces Medical Center v. Ramirez/Ramirez v. Las Cruces Medical Center and Faber & Brand, LLC. D-307-CV-2022-01051. The Plaintiff, or person who brought the class action lawsuit in her name, alleged that Las Cruces Medical Center and Faber & Brand (referred to as Defendants) violated the law when they filed collections actions, including lawsuits and wage garnishments, against class members. The Plaintiff and Defendants have reached a settlement to resolve the claims and defenses.  In agreeing to settle, Defendants have not admitted they did anything wrong.

Important Information About Your Legal Rights 

The proposed settlement covers all patients who had collections actions filed against them by Defendants after December 28, 2022 for allegedly unpaid medical debt. 

The settlement requires Defendants to:

• Pay $399,375. Which includes:
  • $625 for each class member.
  • $200,000 to be refunded to class members for amounts they paid to LCMC.
  • An amount to each Class Representative for the work the Representative had to do to achieve the class action settlement.  Plaintiffs will ask the Court to award $10,000 to the class representative in this case.
  • $20,000 for costs to administer the settlement.
• Change policies to comply with the New Mexico Patients Debt Collection Protection Act to determine whether patients are low income before filing collections actions.
• Pay attorney’s fees and costs in the amount approved by the Court. Class Counsel will seek less than $150,000 in attorneys’ fees and costs from the Court. Any award of fees and costs will be paid separately from the money that is paid to class members.

The Notice you received helps you to understand the settlement and to determine if you are a class member. Then decide if you want to:

Este aviso es para informarle sobre un acuerdo propuesto en una demanda colectiva que se presentó en el Tercer Distrito Judicial del Condado de Doña Ana. La demanda se llama, Las Cruces Medical Center v. Ramirez/Ramirez v. Las Cruces Medical Center y Faber & Brand, LLC. D-307-CV-2022-01051. La Demandante, o persona que entabló la demanda colectiva en su nombre, alegó que Las Cruces Medical Center y Faber & Brand (denominados Demandados) violaron la ley cuando entablaron acciones de cobranza, incluidas demandas y embargos de salarios, contra los miembros de la demanda colectiva. La demandante y los demandados han llegado a un acuerdo para resolver las reclamaciones y defensas.  Al aceptar llegar a un acuerdo, los Demandados no han admitido haber hecho nada equivocado.

Información Importante Sobre sus Derechos Legales

El acuerdo propuesto cubre a todos los pacientes que tuvieron acciones de cobro presentadas contra ellos por los Demandados después del 28 de diciembre de 2022 por deudas médicas supuestamente impagadas. 

El acuerdo requiere que Demandados:

•  Pagar $399,375. Que incluye:
  • $625 por cada miembro de clase.
  • $200,000 que se reembolsarán a los miembros de la demanda colectiva por las cantidades que pagaron a LCMC.
  •  Una cantidad a cada Representante de Clase por el trabajo que el Representante tuvo que hacer para lograr el acuerdo de la demanda colectiva.  Los Demandantes solicitarán al Tribunal que otorgue $10,000 al representante de la demanda colectiva en este caso.
  • $20.000 en concepto de costos de administración del acuerdo.
• Cambiar las políticas para cumplir con la Ley de Protección de Cobro de Deudas de Pacientes de Nuevo México para determinar si los pacientes son de bajos ingresos antes de presentar acciones de cobro.
• Pagar los honorarios y costos de los abogados en la cantidad aprobada por el Tribunal. Los Abogados de la Clase solicitarán al Tribunal menos de $150,000 en honorarios de abogados y costos. Cualquier adjudicación de honorarios y costos se pagará por separado del dinero que se pague a los miembros de la clase.
